MyGov.be Terms and Conditions of Use – 1.0 – 16 January 2024

The installation and use of the app MyGov.be on your mobile device and the use of the MyGov.be website are subject to the following terms of use (“Terms and Conditions of Use”). You are kindly requested to read the Terms of Use carefully before making use of the app Mygov.be and website MyGov.be in any way.

Before using the app Mygov.be on your mobile device and the website MyGov.be, you must expressly agree to these conditions If you do not agree with its contents, please do not install and do not use the app MyGov.be.

By visiting the MyGov.be website you agree to the terms and conditions of use regarding the use of the website. If you do not agree to the terms of use, you are kindly requested to leave the website.

1. Purpose and contents of MyGov.be

MyGov.be app and the website MyGov.be are provided to you by the Federal Public Service Policy and Support, ("FPS BOSA")

MyGov.be is an application or App that you can install on your mobile device.

The objective of MyGov.be is to facilitate access to public services, by providing a simple and secure way to identify yourself. This application also allows you to easily request and receive official documents via the Counter, keep them in a safe place and communicate securely with the public administration via My ebox, the mobile version of My ebox.

MyGov.be is therefore, a digital key that allows you to authenticate yourself online. You can prove that it you at a reliably high confidence level. More information about digital keys can be found here: https://www.csam.be/en/egov-profile.html.

In the future, the App will allow for the possibility to apply qualified electronic signatures.

The MyGov.be website is used in the context of activation of the MyGov.be application. You can also manage your activated MyGov.be application(s) via the website and contact the helpdesk for support. We inform you about all new developments associated with MyGov.be via the MyGov.be website.

We pay special attention to your privacy and the security of MyGov.be and its content.

3. Choosing to use MyGov.be

If you choose to use the app MyGov.be on your mobile device, you will be required to register and will be asked to expressly agree to these Terms and Conditions of Use and the Privacy Statement. This gives you the right to use MyGov.be according to these terms and conditions of use.

To use MyGov.be, you will need to register via CSAM using the electronic identity card or other digital key that will be accepted for this purpose so that it is certain that your MyGov.be is only associated with you. You can install MyGov.be associated with your person on different mobile devices.

Subsequently, you will activate MyGov.be as a digital key so you can use it to access government applications.

If you have chosen My eBox to receive your eBox messages, you will also automatically receive them in MyGov.be when you have installed it.

You can give your consent separately to receive notifications in MyGov.be, for example, if you have received a message.

You are solely responsible for the management and conservation of documents in the app MyGov.be. For privacy/security reasons, we cannot do this for you (unless we receive a legal obligation to do so for certain types of documents)

You can delete the stored documents yourself. They will be automatically deleted if you delete your profile, reinstall the MyGov.be app or enter three incorrect PIN codes.

The website is public and accessible to all visitors. You agree to use the website and its contents only in accordance with the Terms and conditions of use and for lawful purposes. The content can only be used for non-commercial and private purposes.

You are prohibited from using, intentionally or unintentionally, any harmful type of software, or from introducing any harmful programs or files (i.e. a virus) or from any other act to gain unlawful access to MyGov.be (application or website) , modify its content, or disrupt its services

4. Liability

The government services make great efforts to ensure the data, messages and documents offered in MyGov.be are complete, correct, accurate and updated. Despite these efforts, inaccuracies may occur. If the data, messages or documents provided contain inaccuracies or certain data, messages or documents are unavailable, efforts will be made to correct this as soon as possible. If you should find inaccuracies in the data, messages and documents provided, you can always contact the relevant government service or the FPS BOSA service desk.

FPS BOSA makes every effort to secure the application by all reasonable means and to minimise any inconveniences caused by technical errors. However, FPS BOSA cannot exclude the possibility that incorrect technical actions or unauthorised interventions take place. For these reasons, FPS BOSA cannot guarantee that access to the application or website will not be interrupted or otherwise disrupted by such problems. In the event of technical problems, please contact FPS BOSA.

FPS BOSA expressly reserves the right to interrupt access to MyGov.be at any time and without prior notice in order to detect or suppress potential cases of abuse or fraud or rectify technical or operational functional faults.

If FPS BOSA determines or reasonably suspects that you are not complying with the conditions regarding MyGov.be, FPS BOSA may deny you access to MyGov.be at any time.

FPS BOSA cannot, under any circumstances, be held liable for direct or indirect damage caused by the installation or use of this application or use of the website or the receipt or storage of the data, messages or documents provided.

Under no circumstances can FPS BOSA be held liable for the security of your mobile device or the device used to visit the website.

5. Changes

FPS BOSA reserves the right to change these Terms and Conditions of Use at any time. FPS BOSA will inform you of this so you can terminate your registration for MyGov.be if necessary. These Terms of Use were last changed and reviewed on 16 January 2024.

6. Protection of your personal data

FPS BOSA respects your privacy. The details that you enter into the website will be treated confidentially. FPS BOSA processes the data for providing MyGov.be according to the General Data Regulation (GDPR). For more information, please consult our Privacy Statement.

7. Applicable law and applicable court

These Terms and Conditions of Use and the Privacy Statement are governed by Belgian law. By using this service or by visiting the website you agree that in the event of a dispute, only the courts and tribunals of Brussels are competent.
